(Update, October 6th) : After accessing my records and consulting a colorectal surgeon specialist, I found that the claim will not need to be made for the uninformed consent from the nurse because a) It turns out it was a doctor, not a nurse, and I was mistaken. I gave my consent for the digital rectal exam as "If you are a doctor" which sae is. I thought later that it turned out that person was a nurse, but it turns out in the end that's not true and I was mistaken at a later point. And b) It turns out that doctor had reason to believe that an MRI may be very hard to get intime, making a digital exam an fairly reasonable choice for more immediate ER style addressing of a possible fistula. It is not very standard, but I feel that came from concern for my more immediate wellbeing. However, I am still making the claim about the surgeon who was consulted for a second opinion after the rectal exam. That surgeon told me that if I have a fistula "That's Chron's Disease" and that is not true, nor is it likely — and it was a very terrifying thing to say to someone. Even if sae had said "That COULD BE Chron's Disease", the chances are only 1 or 2% or so. I believe that fails to meet professional standards.
